In Re: Estate of Recasens
In this contested estate proceeding our firm represented the Executor and successfully defended against a challenge to the decedent's will by a family member who had been excluded from the will. Through extensive litigation and discovery, including S.C.P.A. 1404 Examinations, our firm defeated the challenge to the will and ensured our client was appointed as the Executor and that the wishes of the decedent were carried out.
In Re: Estate of Pillai
Our firm represented the spouse of the decedent and the proposed Executrix under the decedent's will, and successfully challenged a purported subsequent will submitted by an alleged acquaintance of the decedent. The purported subsequent will would have disinherited our client, and our experience in the New York State Surrogate's Court allowed us to expeditiously defeat this alleged second will and permitted our client to proceed as the sole beneficiary under the decedent's will.
In Re: Estate of Castaluzzo
In this probate proceeding our firm represented the proposed Executor and successfully defeated a challenge by a family member of the decedent to our client's appointment as Executor. The decedent's will was fully probated and the wishes of the decedent were fulfilled.
Yehuda Aminov v. Forest Diamonds
Our firm represented the defendant in an action for contribution under C.P.L.R. 1402 wherein the plaintiff sought approximately $9,000,000 from our client in connection with a prior federal lawsuit between the parties. Through aggressive motion practice we obtained a complete dismissal of the action against our client.
Graham Street Owners Corp. v. Lewis Long
Our firm represented the tenant in a summary nonpayment proceeding. We interposed a counterclaim alleging rent overcharge in violation of the Rent Stabilization Law and sought treble damages. After a bench trial, we obtained a dismissal of the nonpayment proceeding and secured a $117,000 money judgment in favor of our client arising from our counterclaim. We again prevailed when the landlord appealed the decision in the Appellate Term, and we defeated the landlord's attempt to appeal the decision in the Appellate Division. We subsequently obtained full payment of the judgment to our client.
